Commission opens new investigation into Apple

The European Commission announced on March 25, 2024 that it has opened a new investigation into Apple (link).  The reason for starting this investigation is the entry into force of the Digital Markets Act (see also our earlier news item) and the possible violation thereof by Apple.

This investigation into Apple concerns the issue of whether Apple provides sufficient opportunity for app developers to offer a product or service to consumers outside the Apple App Store. The Commission suspects Apple of ongoing restrictions on app developers.

The Commission will continue to investigate Apple over the next 12 months. If Apple has indeed violated the Digital Markets Act, the Commission could impose significant fines. The Consumer Competition Claims Foundation welcomes this development but also remains critical. Under current law, Apple's conduct has been prohibited for years. The CCC Foundation initiated a lawsuit against Apple in March 2022 on behalf of European consumers. At dispute in that lawsuit is the excessive commission Apple charges when a consumer purchases an app from the Apple App Store or makes an in-app purchase. In fact, consumers currently have no alternative but to buy an app via the Apple App Store or make an in-app purchase via the Apple App Store. As a result, consumers are forced to pay the 30% commission. This is against the law. The CCC Foundation is claiming damages on behalf of these consumers.
