The Netherlands a DMA enforcement paradise?
In previous news reports, we wrote about the Digital Markets Act (the ‘DMA’). A new European law that contains strict rules for big tech companies, such as Apple (see earlier coverage
here).
Professor Giorgio Monti, chairman of the supervisory board of the CCC Foundation, wrote a paper on the DMA together with colleagues from Tilburg University. This paper shows how the Netherlands contributed to the creation of the DMA. It also shows how the Consumer & Market Authority (the ‘ACM’) is preparing to play an important role in enforcing the DMA in the Netherlands.
Professor Monti and his co-authors expect that the Netherlands could have an important role in the regulation of digital markets for several reasons.
For instance, the ACM has shown in recent years that it actively enforces competition law in digital markets. In addition, the ACM is driven to explore with other regulators whether they can achieve cooperation benefits through the so-called ‘Digital Regulation Cooperation Platform’ (more on this can be found
here ). Finally, the Netherlands has a strong collective action system - of which the claims of Stichting CCC against Samsung/LG and Apple are an example. This could strengthen private enforcement, and thus regulation, of the DMA.
